Abstract

America after Tocqueville complements Harvey Mitchell's previous book, Individual Choice and the Structures of History: Alexis de Tocqueville as Historian Reappraised (1996). This study draws on Democracy in America to study the condition of democracy in the United States in our own time. Three aspects of Americanism inform Harvey Mitchell's book, and cannot be separated from Tocqueville's consideration of the three races. First, he addresses tensions in the United States between ideas of equality and a political system that tries to keep it within bounds. He turns to the relationship between this system and the dynamics of American capitalism. and he analyses the criteria for inclusion and exclusion in American life. Overall, he asks if Americans have surrendered to what Tocqueville called the materialization of life; if that compromise means their abandonment of their original spiritual quest; and, if they are on the way to a radical alienation from politics.

Abstract

Politicians have long questioned, or even been openly hostile to, the legitimacy of judicial authority, but that authority seems to have become more secure over time. What explains the recurrence of hostilities and yet the security of judicial power? Addressing this question anew, Stephen Engel points to the gradual acceptance of dissenting views of the Constitution, that is, the legitimacy and loyalty of stable opposition. Politicians' changing perception of the threat posed by opposition influenced how manipulations of judicial authority took shape. Engel's book brings our understanding of these manipulations into line with other developments, such as the establishment of political parties, the acceptance of loyal opposition, the development of different modes of constitutional interpretation and the emergence of rights-based pluralism.

Abstract

Some of the most important eras of reform in US history reveal a troubling pattern: often reform is compromised after the initial legislative and judicial victories have been achieved. Thus Jim Crow racial exclusions followed Reconstruction; employer prerogatives resurged after the passage of the Wagner Act in 1935; and after the civil rights reforms of the mid-twentieth century, principles of color-blindness remain dominant in key areas of constitutional law that allow structural racial inequalities to remain hidden or unaddressed. When momentous reforms occur, certain institutions and legal rights will survive the disruption and remain intact, just in different forms. Thus governance in the post-reform period reflects a systematic recalibration or reshaping of the earlier reforms as a result of the continuing influence and power of such resilient institutions and rights. Recalibrating Reform examines this issue and demonstrates the pivotal role of the Supreme Court in post-reform recalibration.

Abstract

Because political campaigns in the United States are privately funded, America's political system is heavily biased toward the interests of wealthy campaign contributors. As a result, government policies have largely ignored the growth in income inequality caused by technological change and economic globalization. This omission has been tolerated because most Americans do not support interventionist government policies. They believe that the government serves the interests of the campaign donors rather than the public. This skepticism concerning the public sector's fairness must be overcome before effective programs to offset mounting inequality can be implemented. Though in recent years legislation to reform the financing of political campaigns has been adopted, private wealth continues to dominate the political process. Political cynicism therefore persists. A voluntary system of public funding of candidates for office is required to generate the trust in the public sector necessary to reverse the trend toward inequality.

Abstract

Political scientists have long painted American voters' dependence on partisan cues at the ballot box as a discouraging consequence of their overall ignorance about politics. Taking on this conventional wisdom, Jeffrey D. Grynaviski advances the provocative theory that voters instead rely on these cues because party brand names provide credible information about how politicians are likely to act in office, despite the weakness of formal party organization in the United States. Among the important empirical implications of his theory, which he carefully supports with rigorous data analysis, are that voter uncertainty about a party's issue positions varies with the level of party unity it exhibits in government, that party preferences in the electorate are strongest among the most certain voters, and that party brand names have meaningful consequences for the electoral strategies of party leaders and individual candidates for office.
